Please read these Terms of Service ("Terms") carefully before using nurelune.com (the "Site") or purchasing any product from us.

Nurelune is a brand operated by Mariana Touch LLC, a United States limited liability company located at 1500 N Grant St Ste N, Denver, CO 80203, United States.

These Terms constitute a legally binding agreement between you and Mariana Touch LLC, operating as Nurelune ("Nurelune," "we," "us," or "our").

By accessing or using the Site, placing an order, or purchasing any product from us, you agree to be bound by these Terms.

1. ELIGIBILITY

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order through this Site.

By using the Site or placing an order, you represent that you have the legal capacity to enter into a binding agreement.

2. PRODUCTS, PRICING & AVAILABILITY

We make reasonable efforts to ensure that product descriptions, images, specifications, prices, and other information displayed on the Site are accurate.

However, we do not warrant that all information will always be complete, current, or error-free.

We reserve the right, at any time and without prior notice, to:

  • Correct errors, inaccuracies, or omissions;

If we cancel an order after payment has been successfully processed, we will refund the applicable amount to the original payment method.

3. PRODUCT USE, HEALTH & SAFETY

The Nurelune™ Heated Sinus Mask is intended for personal comfort and wellness use.

Information provided on the Site is for general informational purposes only and is not intended as medical advice.

The product is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

References to warmth, sinus pressure, facial discomfort, relaxation, or similar experiences describe intended comfort-related uses and do not guarantee any particular medical or health outcome.

Individual experiences may vary.

If you have an existing medical condition, are pregnant, have impaired sensation, sensitive or compromised skin, circulation problems, or are uncertain whether the product is appropriate for you, consult a qualified healthcare professional before use.

Always use the product in accordance with the instructions, warnings, and safety information provided with the product.

To the extent permitted by applicable law, Mariana Touch LLC and Nurelune are not responsible for injury or damage resulting from misuse, unauthorized modification, failure to follow product instructions, or use contrary to stated warnings.

Nothing in this section limits any rights or remedies that cannot legally be excluded.

4. ORDERS & PAYMENT

By submitting an order, you represent that:

  • The information you provide is accurate and complete;

  • You are authorized to use the payment method submitted;

  • You authorize us and our payment service providers to process the applicable charges associated with your order.

Unless otherwise stated, all prices displayed on the Site are in United States Dollars (USD).

Payments are processed through third-party payment service providers.

We do not directly store complete payment card information where such information is handled by our payment processors.

We reserve the right to refuse, cancel, or place an order under review where we reasonably believe the transaction may involve:

  • Fraud;

  • Unauthorized payment activity;

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

EXCEPT FOR ANY EXPRESS RIGHTS, WARRANTIES, OR GUARANTEES PROVIDED IN OUR PUBLISHED POLICIES OR REQUIRED BY APPLICABLE LAW, WE DISCLAIM WARRANTIES THAT MAY OTHERWISE BE IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • THE SITE WILL ALWAYS BE AVAILABLE, SECURE, ERROR-FREE, OR UNINTERRUPTED;

  • ALL SITE INFORMATION WILL ALWAYS BE COMPLETE OR ACCURATE;

  • A PRODUCT WILL PRODUCE A PARTICULAR PERSONAL, WELLNESS, OR HEALTH-RELATED RESULT.

Some states or jurisdictions do not permit the exclusion or limitation of certain warranties.

In those circumstances, the exclusions above apply only to the maximum extent permitted by applicable law.

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MARIANA TOUCH LLC, NURELUNE, AND THEIR OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, SERVICE PROVIDERS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO:

  • YOUR ACCESS TO OR USE OF THE SITE;

  • YOUR INABILITY TO ACCESS OR USE THE SITE;

  • YOUR PURCHASE OF A PRODUCT;

  • YOUR USE OR MISUSE OF A PRODUCT; OR

  • ANY TRANSACTION MADE THROUGH THE SITE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY ARISING OUT OF A PARTICULAR ORDER OR PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT GIVING RISE TO THE CLAIM.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including liability that cannot legally be waived for personal injury, defective products, fraud, willful misconduct, or other legally non-excludable liability.

10. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless Mariana Touch LLC, Nurelune, and their respective officers, employees, contractors, agents, and affiliates from claims, losses, damages, liabilities, and reasonable legal expenses arising directly from:

  • Your unlawful or unauthorized use of the Site;

  • Your material violation of these Terms;

  • Your violation of applicable law; or

  • Your infringement of another person's rights.

This provision does not require you to indemnify us for conduct for which indemnification cannot lawfully be required.

11. GOVERNING LAW & DISPUTE RESOLUTION

These Terms, and any dispute or claim arising out of or relating to these Terms, the Site, an order placed through the Site, or a product purchased from Nurelune, shall be governed by and construed in accordance with the laws of the State of Colorado, United States, together with applicable federal laws of the United States, without regard to conflict-of-law principles.

Nothing in these Terms is intended to deprive a consumer of any mandatory rights or protections available under the laws of the jurisdiction in which the consumer resides where those rights cannot legally be waived.

and provide a reasonable opportunity for us to attempt to resolve the dispute informally.

Subject to applicable law and any non-waivable consumer rights, disputes arising from these Terms, the Site, or transactions with Nurelune may be brought before a court of competent jurisdiction located in Denver, Colorado, United States.

Nothing in these Terms prevents either party from exercising any right or remedy that cannot legally be limited or waived.

12. RETURNS, REFUNDS & SHIPPING

Purchases made through the Site are also subject to our separately published:

These policies form part of the terms applicable to your purchase.

If there is any inconsistency between these Terms and a specific provision of our Refund Policy relating to returns or refunds, the applicable Refund Policy will govern that return or refund, except where applicable law requires otherwise.

constitute the agreement between you and Mariana Touch LLC, operating as Nurelune, regarding your use of the Site and purchases made through the Site, except to the extent otherwise required by applicable law.
